BARRETT, Circuit Judge.
Dr. A. Scott Devous appeals Ms conviction on three counts of violation of the federal drug statutes. Count I of the indictment charged Devous with the knowing and intentional distribution of a Schedule II controlled substance (Demerol), outside the course of his professional practice, to one Dawn Velikaneye, in violation of 21 U.S.C. § 841(a)(1). Count II charged that Devous had knowingly and intentionally acquired Demerol by misrepresentation, fraud, deception or subterfuge, in violation of 21 U.S.C. § 843(a)(3).
