This matter was before this court in Boiselle v. Rogoff, 126 Conn. 635, 13 Atl. (2d) 753. The general picture is adequately presented in that case. The plaintiff’s claims of proof in so far as they are necessary to present the legal issues in this case are as follows: On November 17, 1936, the defendant company was engaged in the general construction business in New London and the plaintiff ran a service station.
