Sitting by Designation.

This case first came on for trial before a jury on October 25, 1974, on the issues of validity and infringement of the Rice patent No. RE 25,360. The issue of infringement was not submitted to the jury because the parties made a pretrial stipulation of defendants’ infringement. However, the validity issue was tried to the jury. A special verdict was rendered by the jury, and, in accordance therewith, the Court entered judgment of validity of the Rice patent.
