Heublein, Inc., (Heublein) appeals from the final judgment of the United States District Court for the Western District of Wisconsin which held that Heublein failed to establish that it had a license, express or implied, to make and use three high-speed taco shell fryers and, thus, that Heublein infringed all of the claims asserted in the four patents in suit. 1 The district court entered a permanent injunction against Heublein’s making, using or selling infringing fryers, including the fryers in suit, and awarded damages in the amount of $1,485 million based on a…
