I. INTRODUCTION.

Plaintiff Allstate Insurance Company (“Allstate”) brings this declaratory action to determine whether, pursuant to a homeowner’s insurance policy, it must defend and indemnify Paul S. Takeda (“Takeda”) in a tort action.
