Appellant, Chambers and Company, a partnership, sued Appellee, the Equitable Life Assurance Society of the United States, for $60,000.00 and interest as a commission for originating a loan to be made to Statler-Dallas Company, Inc. The contract for the payment of the fee rested in a series of written communications between the three parties named, Statler-Dallas Company, Inc. not being a party to this action.
