This action was filed in the district court of Tulsa county by the Tar-rant Investment Company, a corporation, against J. E. Burke for a balance due on a promissory note. The cause went to trial before a jury, and at the conclusion of the evidence the court instructed a verdict in favor of plaintiff for the unpaid balance due on the promissory note, with interest, from which order of the court defendant has appealed. Parties will be referred to as they appeared in the trial court.
