Appeal from Clay District Court. — Hon. A. D. Bailie, Judge. Action in equity to quiet plaintiff’s title to land. The defendants deny plaintiff’s claim of title, and by cross-bill ask that the same be quieted in themselves. Decree for plaintiff, and defendants appeal. —

The land in controversy is a part of section twenty-seven, township ninety-seven, range thirty-five, in Clay County, Iowa. The original government survey of this section was completed about the year 1857, and by act of Congress, approved May' 12, 1864, it was included in a grant of land to aid in the construction of a railroad crossing the northern portion of this State. The company which first undertook the construction of this *421road and to secure the benefit of the grant was known as the McGregor & Western Railroad Company whose rights were subsequently acquired by the Chicago,…
