Plaintiff sued and recovered damages for ' personal injuries which befell him while in the employ of the defendant, and which injuries he charged resulted from his falling into an excavation negligently constructed and maintained by defendant upon its premises. Defendant appeals from the judgment and from the order denying its motion for a new trial.
