Plaintiff sued in ejectment to recover possession of certain property, which possession was withheld by defendant after service upon him of thirty days’ notice to quit. In separate counts and causes of action plaintiff sought to recover, besides the possession of the property, damages for its detention and the value of the rents and profits. (Sullivan v. Davis, 4 Cal. 291 ; Johnson v.
