This is an appeal from an order modifying an interlocutory judgment of divorce.

A résumé of some of the facts and the procedure taken is as follows:

On November 21, 1960, plaintiff wife, by and through Hammons & Willard, by Hal V. Hammons, Jr., filed a complaint for a divorce charging extreme cruelty. It was therein alleged that “there are no children the issue of said marriage.” (Emphasis added.)
