This is an operators license suspension appeal wherein the Department of Transportation, Bureau of Driver Licensing (Bureau), appeals here an order of the Court of Common Pleas of Luzerne County sustaining the appeal of Henry Goldowski, Appellee, from a Bureau order suspending his operating license. The Bureau suspended his operators license pursuant to Section 1547(b) of the Vehicle Code, 75 Pa. C. S. §1547(b), due to his refusal to submit to a chemical test to determine the alcohol content of his blood. We reverse.
