Th.is suit was instituted by plaintiff, Frazier McDonald, against Scott county, Tennessee, and the town of Oneida, an incorporated municipality, located in said county, to recover damages alleged to have been suffered by him by reason of the raising of the grade of the highway, or street, in front of his property. Demurrers interposed by defendants to the declaration were sustained by the trial judge and the suit dismissed. Plaintiff has appealed to this court and assigned errors.
