Plaintiffs below, Clara Belle Fuller and Ethel C. Fuller, instituted this action in the Circuit Court of Hamilton County to recover the sum of $20,000 from the City of Chattanooga, representing damages alleged in the declaration to have resulted to plaintiffs’ property as the result of a change of the grade of Market Street and the construction of an approach to Market Street from Sixteenth Street above the established grade of Sixteenth Street in front of their property.
