This suit originated in the Circuit Court of Hardeman County, Tennessee. It is an original suit brought by defendant-in-error, plaintiff below, M. L. Callahan, hereinafter designated as plaintiff, on May 3,1952, against the Town of Middleton, Hardeman County, Mc-Dade and McDade, a contracting firm and C. W.
