On May 10, 1996, the Nye County District Attorney (“D.A.”) charged petitioner Virginia Lee Sandy (“Sandy”), in the Justice Court of Pahrump Township, with first-degree murder with use of a deadly weapon. Following plea negotiations, Sandy agreed to plead guilty to voluntary manslaughter and to waive her right to a preliminary hearing. During an appearance before a justice of the peace on July 2, 1996, Chief Deputy D.A. Thomas Cochrane (“Cochrane”) stated that the D.A.’s office had agreed to the plea bargain.
