I. Introduction

This is a criminal case. Defendant-Appellant, Antwand DeShion Hawkins (Hawkins), appeals from his conviction and sentence entered under a plea agreement, specifically claiming that the district court erred in failing to require the Plaintiff-Appellee, the United States of America (the government), to move for a downward departure under U.S.S.G. § 5K1.1 based on Hawkins’s substantial assistance.
