This suit was brought by plaintiff, a machinist and toolmaker, because he suffered an alleged financial loss in constructing an impedance measuring line and center conductor for the National Bureau of Standards under a contract with the defendant.

The case was referred under Rules 45 and 46, 28 U.S.C.A. to Mastin G. White, a trial commissioner of this co'urt, with directions to make findings of fact and recommendations for conclusions of law. The commissioner did so in a report filed October 29, 1957, followed by the filing of exceptions by plaintiff and the filing of briefs by both parties.…
