On October 15, 1929, the appellant and defendant below, Life & Casualty Insurance Company of Tennessee, issued and delivered to James T. Wheeler an insurance policy on his life in which it agreed, upon conditions therein specified, to pay to the beneficiary therein named, who was insured’s wife and the appellee and .plaintiff below, Maggie Wheeler, the sum of $5,000. The premiums were agreed to be paid quarterly in advance, the first one -being paid at the time of the delivery of the policy. The others were due each three months thereafter, which…
