Respondent moved to dismiss this juvenile delinquency petition alleging that the respondent, as a member of the Flying Dragons youth gang, did acts which if done by an adult would constitute, inter alia, the charge of attempted grand larceny in the second degree. The grounds for dismissal center on an alleged failure to comply with the time requirements of Family Court Act § 340.1 that mandate that a juvenile must be brought to trial within 60 days of his or her initial appearance or within an additional 30 days upon motion of the presentment agency for…
