FINDINGS OF FACT AND CONCLUSIONS OF LAW
PHILIP PRATT, District Judge.
Plaintiff brings his claim pursuant to the Petroleum Marketing Practices Act (PMPA), 15 U.S.C. § 2801 et seq., alleging that Mobil Oil Corporation illegally failed to renew its franchise and lease agreements with plaintiff. The defendant Mobil Oil maintains that the PMPA permits the non-renewal since plaintiff continually refused to comply with the hours of operation in the lease agreement, which defendant asserts is a reasonable and material provision justifying nonrenewal. 15 U.S.C. § 2802(b)(2)(A) & (B).
