Rosen, J.:

On December 10, 2010, this court heard arguments in the first-degree felony-murder appeal of defendant John Hemy Horton. We have determined that the record is insufficient for determination of one of the issues that Horton raised on appeal; Did the district court commit reversible error when it held that it had no jurisdiction to reopen the evidence after the jury began deliberating? This court therefore remands the case to the district court for a new hearing and decision relating to this issue.
