This is an appeal from a judgment of the United States District Court for the Western District of Oklahoma against Louis Gi-uffrida, Director of the Federal Emergency Management Agency (“FEMA”), and in favor of plaintiff-appellee Lawrence Penny, for $35,000. On appeal, FEMA argues that the district court incorrectly held that FEMA was estopped from denying liability, that the district court erred in awarding Penny recovery on inconsistent theories, and that the district court’s award of interest was improper.
