INTRODUCTION
In this proposed nationwide class action, plaintiff Ashby Henderson, a trust beneficiary, alleges that the defendants, the Bank of New York Mellon, N.A. (BNY Mellon) and associated entities,1 breached their fiduciary duty to thousands of beneficiaries of trusts for which" BNY Mellon serves as trustee, by imprudently investing the trust assets in poorly performing proprietary financial instruments.
