This is an original proceeding in this court brought by McGeorge Corporation and its insurance carriers, as petitioners, to obtain a review of an award made by the State Industrial Commission in favor of the respondent Roy Lynch. We will hereafter refer to the parties as petitioners and respondent, unless a more explicit designation is required.

The sole grounds assigned for the vacation of the award are: First, the injury did not arise out of and in the course of employment ; second, the respondent was not engaged in a hazardous employment at the time of his injury. We will discuss these in…
