These are cross appeals in an article 78 proceeding from an order of the Appellate Division, Second Department, which modified an order of the 'Supreme Court, Nassau *141County, Special Term (Smith, J.), upholding the determination of the Board of Zoning Appeals and dismissing the petition.
Petitioners are the owners of slightly more than two acres (90,000 sq. ft.) of property situated in the Village of Brookville, Nassau County. At the time of the enactment of the village’s original zoning ordinance in 1935, petitioners’ property was part of a large estate acquired by Ormond Smith in the 1920’s.…
