Defendant was charged in the superior court for Thurston county with the crime of Sabbath breaking, in that on Sunday, April 11, 1937, at or about the hour of twelve-thirty o’clock a. m., he. . then and there did wilfully and unlawfully sell, offer for sale and expose for sale personal property, to-wit, intoxicating liquors, to-wit, beer and wine.”
To that information the defendant interposed a demurrer, which was sustained. The state has appealed.
