The appellant, as plaintiff, brought this action on behalf of himself, and all others similarly situated, to enjoin the defendants from in any manner interfering with the dispensing of beer and wine in connection with the regular conduct of the hotel and restaurant business on Sundays.

A demurrer to the complaint was interposed and sustained. The plaintiff stood on his complaint and refused to plead further, whereupon a judgment dismissing the action with prejudice was entered, and from that judgment the plaintiff has appealed.
