Plaintiffs Vermont Public Interest Research Group (“VPIRG”), National Audubon Society (“NAS”), and Sylvia Knight (“Knight”), filed this action on October 30, 2001, seeking declaratory and injunctive relief requiring the United States Fish and Wildlife Service (“FWS”) to comply with the National Environmental Policy Act (“NEPA”) and the Administrative Procedure Act (“APA”) by assessing certain environmental impacts of the proposed release of lamprieides into Lewis Creek and other tributaries of Lake Champlain. 1 Plaintiffs moved for summary…
