1Opinion of the CourtBogdanski, J.

The plaintiffs, Thomas and Dorothea Falco, brought this action for an injunction and for money damages against the defendants, Francois and Marie Simon, hereinafter called the defendants, claiming that the artificial alteration of the contour of the defendants’ land injured the plaintiffs’ contiguous property by changing the natural flow of surface water. The matter was referred to the Hon. James P. Doherty, state referee, who, exercising the powers of the Superior Court, awarded money damages to the plaintiffs. Prom the judgment so rendered, the defendants have appealed to this court.
