This action was instituted in the district court of Pawnee county by the plaintiff in error against the defendant in error, based upon a Written contract made between the plaintiff and the Hammer Brick Company, and transferred to the defendant herein. To plaintiff’s petition, the defendant filed a demurrer, which was not passed upon for some reason not shown- in the record. Defendant afterwards answered, and plaintiff replied.
