MEMORANDUM OF DECISION ON SEVERED ISSUE CONCERNING DAMAGES
NEWMAN, District Judge.
This diversity action for breach of contract and tort arises out of the leasing of data-processing equipment by defendant Burroughs Corporation (“Burroughs”) to plaintiff Applied Data Processing, Inc. (“ADP”). ADP alleges that the equipment failed to function properly and claims damages for breach of express and implied warranties, and for tortious misrepresentation.
