At tbe time of tbe injury complained of tbe defendant was tbe owner of a coal dock on tbe bay in tbe city of Superior and engaged in unloading coal from boats onto said dock. In carrying on tbe business boats loaded with coal are tied up at tbe end of said dock. Tbe floor of tbe dock is a few feet above tbe water of tbe bay. A trestle rests on tbe dock six or eight feet from tbe end of tbe dock and extends above tbe floor of tbe dock about sixty feet.
