The Director of the California Department of Benefit Payments (hereafter “Department”) appeals from a peremptory writ of mandate directing Department to pay Donald W. Biyant and Erma Bryant (hereafter “the Bryants”) Aid to Families with Dependent Children (hereafter “AFDC”) benefits.

The facts are not in dispute. The Biyants’ daughter, Darlene, was bom in October 1955. She was married in April 1971, at age 15. She separated from her husband and returned to her parents’ home on January 26, 1972; she received a final decree of dissolution in August 1972. At all times pertinent…
