Appeal from a judgment of the superior court for Lincoln county, Warren, J., entered July 13, 1905, upon findings in favor of the plaintiff, after a trial before the court without a jury, in an action upon a promissory note.
1Opinion of the CourtDunbar, J.
— This was an action on a promissory note; secured by a real estate mortgage. The defense is, (1) that *102the note was usurious; (2) that the court erred in not finding sufficient payment. The essential part of the note is as follows:
“$1,000.00 Wilbur, Wash., March 25, 1899.
“Tor value received, one year after date, I promise to pay at Wilbur, Wash., to the order of Isaac B. Armstrong, one thousand dollars in gold coin of the United States of America of the present standard value, with interest thereon at the rate of 10 per cent per annum from date until paid.
