The papers referred to in the case agreed and made a part of the case on appeal, show, in addition to the facts set forth in the agreed case, that the property conveyed in the deed of trust to Overman and McCubbins was a town lot worth about $1,000 without the improvements, and improvements on it worth about $1,500.
