On January 31, 1912, the ■plaintiff in error, plaintiff below, commenced this action in the district court of Tulsa county against the defendants in error, defendants below, to enjoin the collection ■of an alleged illegal paving assessment against lot 8, block 3, Hodge addition to the city of Tulsa, one of the' defendants in error here, and to cancel said assessment, as a cloud upon his title to said lot.
