The appellant brought this action in the court below against the appellees as stockhold ers and partners engaged in the business of conducting a private bank under the name of the “Bank of Poneto.”

The appellant’s amended complaint alleged that on the 25th day of July, 1923, and for many years prior thereto, the appellant and the appellees herein were partners engaged in the business of conducting a private bank.
