OPINION

LYDON, Judge:

This Indian Claims case is again before the court, this time on plaintiff’s Motion for Determination of Issues of Law and defendant’s response thereto relating to one particular claim, i.e., the irrigation system claim. The facts are set forth fully, in an earlier opinion discussing this particular claim, 8 Cl.Ct. 470 (1985), but, for purposes of confronting the instant motion, can be stated quite simply.1 Basically, defendant *640obligated itself in 1906 to construct an irrigation system capable of irrigating some 10.000 acres of land as part of an agreement for the Tribe’s…
