Plaintiff appeals from the trial court’s denial of her motion, pursuant to N.C.R. Civ. P. 59 and 60, to vacate and set aside the order *360entered 4 February 1994 dismissing plaintiffs appeal. We reverse and remand.

On 8 January 1992 plaintiff filed a complaint seeking damages for personal injuries sustained as a result of an automobile accident. On 16 March 1992 defendant filed an answer denying negligence and alleging contributory negligence. At trial the issues of negligence, contributory negligence, and damages were submitted to the jury.
