MEMORANDUM OF DECISION AND ORDER

The Plaintiff, John Eiden (“the Plaintiff’) brings this action against the Defendants, Gina McCarthy (“McCarthy’) and Linda Yelmini (‘Yelmini”) (collectively, “the Defendants”), pursuant to 42 U.S.C. § 1983, alleging violations of his rights under the First and Fourteenth Amendments to the United States Constitution. Now pending before the court is the Defendants’ motion for summary judgment (dkt.# 29) pursuant to Rule 59 of the Federal Rules of Civil Procedure (“Fed. R.
