MEMORANDUM OPINION
STANLEY S. HARRIS, District Judge.
In December 1986, the American Society of Cataract and Refractive Surgery filed a complaint challenging the constitutionality of the Omnibus Budget Reconciliation Act of 1986, P.L. 99-509, which places limits on the amounts physicians may charge Medicare patients for the performance of cataract surgery. The complaint was amended in February to include several doctors and patients who claimed direct injury from the statute. 1 Defendants filed a motion for judgment on the pleadings and for dismissal.
