OPINION AND ORDER

FUSTE, District Judge.

Plaintiffs are suppliers of “durable medical equipment.” They receive reimbursement for the equipment they sell or lease through Part B of the Medicare Program. Part B of the Medicare program is a government sponsored and funded insurance plan. The Secretary of Health and Human Services (the “Secretary”) is ultimately responsible for the implementation of the plan, but has delegated day-to-day administration to local insurance carriers (the “carrier”).
