DAVIS, Circuit Judge.

This was a suit by defendant in error, hereinafter called plaintiff, to recover the balance of the purchase price of 400 tons of steel bars at “$3.50 per cwt., delivered.” Judgment was entered against the defendant for the full amount claimed to be due for want of a sufficient affidavit of defense. The defendant *787sued out a writ of error to this court on the ground that the judge of the District Court erred in entering the judgment.
