Plaintiff-appellant Jerilyn Zinn appeals from the district court’s grant of summary judgment in favor of defendant-appellees David McKune, Fritz Young and the Kansas Department of Corrections (Department).1 See Zinn v. McKune, 949 F.Supp. 1530 (D.Kan.1996). Relying on Lambertsen v. Utah Dept. of Corrections, 79 F.3d 1024 (10th Cir.1996), the district court determined-that Ms. Zinn was not an employee of the Department and dismissed her retaliation claims brought under Title VII of the 1964 Civil Rights Act and Kansas’s common-law “whistle-blower” retaliatory discharge…
