This case is before the court on defendant’s motion to dismiss pursuant to RCFC 12(b)(4) for failure to state a claim upon *286which relief can be granted. Plaintiff has opposed. Argument is deemed unnecessary.

FACTS

The following facts are derived from plaintiffs complaint. Virgil J. Scogin, Sr. (“plaintiff”), owns an industrial parcel of approximately 7.8 acres abutting the Bayou Bonfouca Superfund Site (the “Site”).
