Plaintiff, Maurice Barnes, appeals the trial court's judgment upholding the revocation of his driver's license by the Department of Revenue, Motor Vehicle Division. We reverse and remand.

Plaintiff was arrested by an Aurora Police officer for driving while under the influence of alcohol. As a result, plaintiff's driver's license was subject to revocation. Plaintiff requested a hearing regarding the revocation and notified the Motor Vehicle Division of the Department of Revenue, pursuant to § 42-2-126(8)(e)(I1), C.R.S8.2000, that he desired the presence of the arresting…
