This action arises out of a subcontract, later assigned to the Department of the Army, calling for rehabilitation of the central heating plant of the Hoosier Unit of the Hoosier Ordnance Plant (a portion of the Indiana Arsenal, Charles-town, Indiana). Plaintiff seeks an equitable adjustment to the contract price in the amount of $51,489.55, because of defendant’s refusal to shut down all three boilers in the heating plant simultaneously during the rehabilitation work.
