This is a contract case presented to this court on the record made before the Armed Services Board of Contract Appeals. The case was initially referred to Trial Commissioner C. Murray Bernhardt, who recommended that the plaintiff recover. The parties have submitted further briefs and oral argument has been had before the court. The court agrees with the commissioner that the contractor is correct in its interpretation of the contract. The court also rejects certain defenses, not going to the merits, which the Government has raised. We hold, therefore, that plaintiff is entitled to recover and…
