MEMORANDUM OPINION

JOHN D. BATES, District Judge.

This case, brought by Yassin Abdullah Kadi, 2 a citizen and permanent resident of Saudi Arabia, involves a challenge to the decision of the Office of Foreign Assets Control (“OFAC”) to designate him as a “specially designated global terrorist (“SDGT”).” Presently pending are (1) defendants’ 3 motion to dismiss or, in the alternative, for summary judgment; (2) Kadi’s motion for discovery under Fed.
